S-e-y-a-a-d is a barrister and Head of Legal Practice at My Commercial Lawyers. He has the overall responsibility of managing the law firm and supervising case work on a day-to-day basis.

He has a number of years of legal experience being instructed by government organisations, foreign lawyers overseas and clients in England & Wales. Prior to practising as a barrister, he has worked in house for two large organisations dealing with civil matters.

S-e-y-a-a-d also has experience in prosecuting in criminal offences for a government department to which he is well versed when it comes to criminal procedure. Therefore, defending clients in environmental, health & safety and regulatory offences make it slightly less challenging due to his background in such matters.

Local Experience – England & Wales

  • Advising on settlement agreements in disputed insurance matters.
  • Advising a main construction contractor on its JCT contract in respect to a non-payment & termination of the project with its client.
  • Advising on construction & insolvency law including the liquidation of companies.
  • Instructed to recover fees for a planning consultant.
  • Drafting and filling pleadings relating to Particulars of Claim, Defence,Counterclaim, Reply to Defence for various clients.
  • Negotiating settlement of debts.
  • Currently representing a client to trial who is being prosecuted by the Health & Safety Executive for incident that took place on a construction site.

    International Experience – Middle East

  • A government department involved in a major construction project for an international airport, with a claim worth in excess of £200 million. This case included technical issues under the FIDIC form of contract, such as defects, extension of time, procurement, payment rights, valuation of variations, concurrent delays, and liquidated damages. We led the team in investigating causes of action, drafting statements of case, and initiating legal proceedings.
  • Advising a well-known main contractor in the construction industry regarding performance bonds and subcontract termination. The case involved issues under a bespoke contract, including delays, disruptions, and financial difficulties faced by subcontractors.
  • Defending an international main contractor in the early stages of 12 arbitrations brought by a subcontractor under the Mechanical, Electrical, and Plumbing (MEP) contracts. These cases involved payment disputes, delays, and project disruptions, requiring preparation of ad hoc arbitration
    agreements and management of the arbitration process.
  • Advising a Desalination Plant owner on potential liabilities against the government.
  • Currently advising on third-party funding methods and evaluating the merits of a claim involving a large-scale construction dispute.
